Terms and Conditions and Complaints Procedure

The terms and conditions and complaints procedure set out below are valid and binding for purchases in the online store oreganovy-olej.cz, the supplier of which is the company All in One service s.r.o., Company ID: 27107973, entered in the Commercial Register kept by the Municipal Court in Prague in Section C, Insert No. 96810.

All contractual relations between the buyer and the seller are governed by the valid legislation of the Czech Republic, for natural persons who are not entrepreneurs by the Civil Code No. 40/1964 Coll. and the Consumer Protection Act No. 634/1992 Coll., for natural persons who are entrepreneurs and for legal entities by the Commercial Code No. 513/1991 Coll., all of the aforementioned laws as amended by subsequent legal regulations.

Conclusion of the Contract

The purchase contract is concluded at the moment of acceptance of the order by the seller, in which the buyer fills in the type of goods, number of pieces, price and chooses the place of delivery, method of transport and payment for the ordered goods. By sending the order, the buyer also confirms that he has read and agrees to these terms and conditions and the complaints procedure.

Delivery times

Ordered goods that are in stock are shipped within 2 working days. For goods that are not in stock, the buyer is informed of the possible delivery time within this period. The delivery time is extended by the time that the carrier needs to deliver the goods to the address specified by you.

Price

The goods are delivered at the prices valid at the time of sending the order. Promotional prices are limited by the announced period of their validity, or until stocks run out, unless the seller states otherwise.

Place of delivery, amount of payment for shipping and packaging.

The buyer chooses the method of delivery of the goods in the order:

Free shipping only in the Czech Republic via Czech Post or Zásilkovna (PACKETA).

Payment information will be sent to you by e-mail before the goods are shipped.

Delivery time 1 - 2 business days from the date of order.

Postage price list outside the Czech Republic: Payment in advance (by bank transfer or ComGate, we do not provide cash on delivery service). The postage amount is 8 EUR.

We only charge shipping fees, packaging is free with us. Goods that are transported by an external carrier are packed in protective packaging to prevent damage. The goods are always visibly identified with a label. In the event that the buyer refuses to accept the shipment, the seller reserves the right to claim compensation from the buyer for damages caused by this behavior.

Payment terms

The price for the ordered goods is paid by the buyer:

Withdrawal from the contract

In accordance with Section 53, paragraph 7 of the Civil Code, our online store provides the customer with a protection period of 14 days, calculated from the date of receipt, to return the goods without giving a reason. According to your wishes, you will be refunded your money or we will exchange the goods for others. In the event of withdrawal from the contract, the buyer will send the goods back in the original packaging with all accompanying documents, including the accompanying letter, at his own expense. Goods that will be sent back on delivery will NOT be accepted by the seller.

Goods that have already been partially consumed, are incomplete or damaged cannot be accepted back.

If the buyer is a natural person, entrepreneur or legal entity, mutual relations are governed by the relevant provisions of the Commercial Code. In this case, the buyer cannot withdraw from the contract without giving a reason within 14 days!

In the case below, the seller reserves the right to unilaterally and without compensation withdraw from the purchase contract:

If the buyer repeatedly fails to accept the ordered goods and thus causes damage to the seller.

Return of goods and money

You have the right to return unused goods in the original, undamaged packaging within 14 days of receipt without giving a reason.

Send the goods back in their original packaging as a regular shipment, not cash on delivery. Attach a copy of the invoice, or at least the document number and the account number to which we should send you the money.

Within 30 days of cancellation of the contract, the buyer will be refunded the money in the manner chosen by him:

By collection order, or to the buyer's bank account.

Refund conditions

• the goods must be complete, unused and undamaged, resaleable

• the shipment must be sent no later than 14 days from the date of receipt

• the returned shipment must include a copy of the purchase receipt for the goods you want to return

• we only refund the money for the goods, not for the postage paid by us and you

Invoicing

We want to be environmentally friendly, for this reason we do not send invoices, but you can view them in your account, where you will find a complete history of your orders. If you need a treasure with a stamp, we will be happy to send it to you on request.

Complaints Procedure

The complaints procedure of the online store oreganovy-olej.cz reflects the legal regulations of the Czech Republic, in particular Act No. 40/1964 Coll., the Civil Code and Act No. 634/1992 Coll., on consumer protection. A complaint can only be made if the goods are within the warranty period. The length of the warranty period is given for each item in the catalog. The statutory warranty period for all consumer goods is 24 months (Section 620, paragraph 1 of the Civil Code). The warranty period is extended by the period for which the goods were under warranty repair. In the event of an exchange of goods, or if a component of the product has been replaced, a new warranty period for the given product, or its new part, will begin to run again from the receipt of the new item, or the item with a new component.

The warranty cannot be applied in the following cases:

• the goods were claimed after the warranty period

• the goods were installed, modified or repaired in an unprofessional manner

• the goods were used in violation of the enclosed operating instructions

• the goods were damaged by the elements - water, lightning, fire or electric discharge

• the data in the warranty card was unauthorizedly changed

Contradiction with the purchase contract

If the item does not comply with the purchase contract upon receipt by the buyer (hereinafter referred to as "contradiction with the purchase contract"), the buyer has the right to have the seller bring the item into a condition consistent with the purchase contract free of charge and without undue delay, at the buyer's request, either by replacing the item or repairing it; if such a procedure is not possible, the buyer may request a reasonable discount on the price of the item or withdraw from the contract. This does not apply if the buyer knew about the discrepancy with the purchase contract before receipt of the item or caused the discrepancy with the purchase contract himself. A discrepancy with the purchase contract that becomes apparent within six months of the date of receipt of the item is considered to be a discrepancy that already existed upon receipt of the item, unless this is contrary to the nature of the item or unless the contrary is proven.

Conformity with the purchase contract means in particular that the item sold has the quality and useful properties required by the contract, described by the seller, manufacturer or its representative, or expected on the basis of advertising carried out by them, or the quality and useful properties usual for an item of this type, that it complies with the requirements of legal regulations, is of the corresponding quantity, measure or weight and corresponds to the purpose stated by the seller for the use of the item or for which the item is usually used.

Buyer's rights in the event of a defect occurring during the warranty period:

In the event that a defect occurs during the warranty period, the buyer has the following rights, depending on the nature of the defect, when exercising the warranty:

- if it is a removable defect, the right to free, proper and timely removal of the defect, the right to replace the defective goods or defective parts, unless this is disproportionate given the nature of the defect. If such a procedure is not possible, the buyer has the right to an appropriate discount on the purchase price or withdrawal from the purchase contract,

- if it is an irremovable defect that prevents the proper use of the goods, the right to replace the defective goods or withdraw from the purchase contract, the same rights belong to the consumer, if it is a removable defect, but if the buyer cannot use the thing properly due to the reoccurrence of the defect after repair or due to a large number of defects. A defect is considered to have reoccurred if the same defect preventing proper use, which has already been removed at least twice during the warranty period, occurs again. A greater number of defects is understood to be if the item has at least three defects preventing its proper use at the same time - if other defects are irremovable and the consumer does not request a replacement of the item, he has the right to a reasonable discount on the purchase price or withdrawal from the purchase contract.

Method of complaint

A complaint must be made to the seller. It is advisable to attach a legible original or copy of the proof of purchase to the claimed goods - an invoice or if the purchase must be proven in another way, and to describe the defect. The seller will issue the buyer a written confirmation of when the complaint was made, what its content is, what method of handling the complaint is requested; further confirmation of the date and method of handling the complaint, including confirmation of the repair and its duration, or a written justification for rejecting the complaint.

Deadlines for handling complaints

Complaints are handled without undue delay, but no later than 30 days from the date of their application, unless the seller and the buyer agree on a longer period. After this period has expired, the consumer has the same rights as if it were a defect that cannot be removed.

Costs of the complaint

In the case of a justified complaint, the buyer-consumer has the right to compensation for the costs associated with the complaint (in particular, the postage paid when sending the complained-about goods). The same right also belongs to the consumer in the event of withdrawal from the contract due to a defect in the item. The costs associated with transporting the goods to the customer after the complaint has been handled are covered by the seller.

Handling of complaints

Your complaint will be handled within the statutory period of 30 days from its receipt. If this is not met, the customer has the right to completely new goods or withdrawal from the contract with a refund. If the complaint is recognized as justified, the consumer has the right to reimbursement of the necessary costs incurred in connection with the complaint - the costs of transporting the claimed goods to the seller.

Personal data protection

The processing of personal data is governed by the applicable legal order of the Czech Republic, in particular the Personal Data Protection Act No. 101/2000 Coll., as amended. By sending a binding order, the buyer gives the seller consent to the processing of his personal data in the seller's database until the buyer revokes it in writing. Personal data is used only to process the order and will not be provided or otherwise made available to a third party. The exception is the provision of this data to the necessary extent to an external carrier who will deliver the shipment to the buyer.

Detailed information about individual products is taken from publicly available sources. It is always necessary to carefully study the package leaflet! We also point out that the accompanying photographic images are illustrative only and cannot be a reason for a complaint.

These Terms and Conditions and the Complaints Procedure are valid from 01.01.2025 until further notice.
